Use of Restraint of Isolation with Students

Use of restraint or isolation of any student, including a student who has an individualized education program (“IEP”) or who has in place a plan developed under section 504 of the Rehabilitation Act of 1973 (“504 plan”), may be used consistent with board policy and this procedure. Parents/guardians must be provided a copy of this policy and procedure at the time the IEP or 504 plan is created.

Following the release of a student from the use of restraint or isolation, the school will imple­ment the following:

1) Any school employee, school resource officer, or school security officer who uses restraint or isolation on a student during school-sponsored instruction or activities must inform the building administrator or his/her designee as soon as possible.
2) Within two business days of the incident, the school employee, school resource officer, or school security officer must submit a written report of the incident to the attention of the Student Services Department at the district office. The report should include, at a minimum, the following information:

a. The date and time of the incident;
b. The name and job title of the individual who administered the restraint or isolation;
c. The name of the student;
d. Whether the has an IEP or 504 plan;
e. A description of the activity that led to the restraint or isolation;
f. The type of restraint or isolation used on the student, including the duration;
g. Whether the student or staff member was physically injured during the incident and whether any medical response was required (i.e. on-site medical care, 911 call, etc.).

3) The principal or his/her designee must make a reasonable effort to verbally inform the student’s parent/guardian within twenty-four (24) hours of the incident, and must send a written notice to the parent/guardian within five (5) business days after the incident. If the school or district customarily provides the parent/guardian with school-related information in a language other than English, the written report under this section must be provided to the parent/guardian in that language.
4) The principal or his/her designee will conduct follow-up to review the inci­dent with the student to address the student’s behavior that precipitated the use of restraint or isolation;
5) The principal or his/her designee will review the incident with the staff person(s) who administered the restraint or isolation to discuss whether proper procedures were followed and what additional action, if any, is necessary.
